I was hit by a car while riding my Grom in Sept 2016. I'm still getting lots of pain, discomfort and headaches from the whiplash.

Anyone know of a good firm to call and ask some questions? (ex: Is a lawyer a smart move at this point?)

My automotive health benefits ran up a while ago and now it's all on me and my HSA plan to take care of this stuff.

The other person's insurance has a standing offer of $7500 for me to sign-off on all liability and close the case. It's tempting, but I won't sign anything like that till this pain goes away. Which will likely be never from the stories I've heard.

Absolutely.

At a minimum it's worth a phone call. Whether good or bad, these lawyers generally work ("get paid on") on case outcomes only, and it's almost universally 33%. For this reason it also means they are generally up front about possible outcomes as it may not be worth their time to pursue.

That means with an offer of $7,500, if you moved to getting a lawyer, if they could get a little over $11k instead you would still "break even" but THEY handle all the phone calls. The nicest part is as soon as you get a lawyer, 100% of the phone calls stop from the insurance company and you'll get an update from your lawyer when they feel there is one to give you. The lawyer can help you get things that you are entitled to (that you may not know about) like reimbursement for replacement services - not sure if you would qualify for this or not.

They will likely ask to have you go see an independent Dr. as well for a second opinion. Also to remember, this settlement they are offering is meant to pay for your long term care and Dr. visits as a result of the accident you were a part of.

Message me if you would like more info, we have been through this process both ways.

+1. My wife was hit by a car in college and she ate the curb with her teeth. Long story short, she was pressured into taking the settlement... sounded like a lot of money at the time, but it hardly covered the expenses at the time of the incident... let alone anything that needed fixing down the road.

If you are going to do something, do it now...

If I have a free night, I might just stop by and talk in person. Seems like a complicated matter. I probably won't make a call to a firm for at least a couple weeks. So I'll holler if I find some free time to run down.

Any recommendations for 1-800-Axe-Gary?
(I say that jokingly, but it could be a good service for all I know)

Ha! If I know what I'm doing, I'm fine with that.

Take your pick and choose your own adventure! Main choices include (but not limited to): general trailer maintenance, general truck maintenance, fixing a Saab motor, cutting up the tree that fell in our back yard 3 weeks ago (chainsaw and chaps provided), general lawn and landscape care, running air and electric lines in the garage, staining the playset, and last but not least - motorcycle engine repair.

Well heck, you're already charging as much as a lawyer, you might as well make an LLC and be a law consultant!

When I get back in a couple of weeks I will take care of the tree.

Highly recommended. Feel free to give me a call to talk. I personally know the personal injury lawyer and he's an awesome dude - my wife works for him. He won't fill you full of false promises and will tell you exactly how it is. They're great at suing insurance companies, haha! :)

I just talked with my wife and she said "DO NOT SIGN" that insurance liability release. She said you should most definitely talk to an attorney even if its not her firm, and if the insurance company is already offering that much to you, your case is worth far more than $7500.

My first insight to a law professional's response!

I've been warned, more casually/unprofessionally, not to sign. But coming from someone that sees these scenarios daily, it makes me feel much better and, now, more hopeful for an outcome better than what I expected. I didn't think I'd be looking at much more than 10k.

I think you're looking more at the 30k region before lawyer fees but thats just a "hunch".

Daaaayum. I'll need to look in to financial planning. CRA racers are good financial planners right?
